Terms of sale and license

The terms for buying and using Tomette, the focus timer for the Mac menu bar: the license, updates, refunds and your rights as a buyer.

This text is a draft and is being reviewed before launch.

Buying Tomette

Tomette is sold as a download by Polar, which acts as the merchant of record: Polar is the seller for the purchase, charges any sales tax or VAT, and issues your receipt. Prices are shown before you pay.

Your license

Buying Tomette gives you a personal license to use it on all the Macs you use yourself, including every update within the major version you bought (for example, every 1.x release). A later major version may be offered as a paid upgrade; you can keep using the version you have.

You may not sell, rent or redistribute Tomette, or remove its notices.

Refunds

See the refund policy. Your statutory rights as a consumer are not affected.

Warranty and liability

Tomette is provided as it is, with the care you can reasonably expect. Where the law gives you rights that cannot be limited, such as the legal guarantee that digital content conforms to its description, those rights apply in full.

Otherwise, our liability is limited to the price you paid, except for intent, gross negligence and injury to life, body or health, for which the law does not allow a limit.

Governing law

These terms are governed by the law of the seller’s country of residence. If you are a consumer, you keep the protection of the mandatory laws of the country where you live.
